Terms of Service
These Terms of Service ("Terms") govern your use of the Heads Up Poker mobile application (the "App") provided by OwlSoft ("we", "us"). By using the App you agree to these Terms.
1. The App
Heads Up Poker is a 1-on-1 poker simulation game.
- The App is a simulation game for entertainment purposes only. It is not gambling and does not involve any real money wagering.
- Chips, points, stamps, and other in-app items (collectively, "Virtual Items") have no real-world monetary value.
- Virtual Items cannot be exchanged for cash or other currency, redeemed, or withdrawn.
- Virtual Items cannot be transferred to another user or account.
- Gameplay outcomes have no connection to any kind of real-world prize or payout.
2. Eligibility and Account
- You must be at least 17 years old (19 in South Korea) to use the App.
- The App creates an anonymous account based on your device identifier. Each device holds an independent account.
- You are responsible for the display name you choose. Names that infringe third-party rights, are discriminatory, or violate public morals are not permitted.
3. In-App Purchases
3.1 Paid features
- Premium Subscription (monthly / yearly): ad removal, all stamps, detailed statistics, group tournament hosting. Auto-renewing subscription.
- Remove Ads (one-time): permanent ad removal via a non-consumable purchase.
- Stamp Packs: individual emote stamps, owned permanently.
3.2 Billing terms
- All purchases are processed by Apple App Store or Google Play.
- Virtual Items cannot be exchanged for cash, transferred to others, or withdrawn in any form.
- Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
- The 7-day free trial applies only to the first monthly Premium purchase. Failure to cancel during the trial results in a charge.
- Cancel via the App Store or Google Play subscription settings; we cannot process cancellations on your behalf.
3.3 Refunds
Refunds are governed by Apple App Store and Google Play policies. We do not process direct refunds. Please contact the relevant store for refund requests.
4. Advertising
The App is free to use and shows banner, interstitial, and rewarded video ads. Rewards from rewarded video ads are fixed; there are no random or chance-based reward elements (no lotteries or "loot boxes"). Premium subscribers and users who purchased Remove Ads will not see ads.
5. Prohibited Conduct
You agree not to:
- Collude with others to manipulate match outcomes
- Use bots, cheats, or unauthorized tools
- Harass, threaten, or discriminate against other players
- Reverse-engineer, decompile, or modify the App
- Use multiple accounts or impersonate others
- Trade Virtual Items for real currency (RMT)
- Disrupt the service (excessive requests, exploiting vulnerabilities)
- Violate any applicable law or public morals
Violations may result in suspension, termination of paid features, or denial of service without prior notice.
6. Intellectual Property
The App and all associated source code, graphics, sounds, and text are owned by OwlSoft or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Nothing in these Terms transfers ownership.
7. Service Changes and Termination
We may modify, suspend, or discontinue features at our discretion with reasonable notice. If the service ends, remaining paid entitlements will be handled in accordance with Apple/Google store policies.
8. Disclaimers and Limitation of Liability
- The App is provided "AS IS" without warranty of any kind, express or implied.
- To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our aggregate liability is limited to the amount you paid us in the 12 months preceding the claim.
- We are not responsible for disputes between players matched by the App.
9. Governing Law and Venue
These Terms are governed by the laws of Japan. Any dispute will be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, except where mandatory consumer law in your jurisdiction provides otherwise.
10. Changes to These Terms
We may revise these Terms from time to time. Material changes will be announced in-app or via the App Store / Google Play description. Continued use after the effective date constitutes acceptance of the revised Terms.
